New documents in the Schoharie limousine crash criminal case filed by Schoharie County District Attorney Susan Mallery detail the events leading up to the October 6, 2018, crash that killed 20 people.
Nauman Hussain, the operator of Prestige Limousine, is charged with 20 counts of negligent homicide for the crash. His defense is looking to have the case tossed out.

In the response to a request for dismissal, DA Mallery pointed to Department of Transportation emails that show Hussain unsuccessfully tried to obtain the proper authority to operate the limousine. In the new documents filed with a Schoharie County Court judge last week, the DA claims there was a problem with the limo's brakes as early as prom season in 2017 – the driver telling Hussain about it – and Hussain keeping the vehicle on the road.
In emails to Hussain in both June 2017 and January 2018, a DOT inspector informs him that it cannot carry passengers because it does not have proper bus inspection, which is required for vehicles that transport 11 or more passengers. That same inspector ordered the vehicle out of service after inspections in March and September 2018, citing a number of violations including the brakes, having more seats than permitted, and defective emergency exits.
The DA's documents claim that in the first inspection, Nauman Hussain misrepresented himself as his father, Prestige owner Shahed, and it wasn't until September that he came clean with the DOT inspector.
Hussain's defense is arguing repairs done at Mavis Discount Tire in May of that year were inadequate, and Hussain didn't know. The DA disputes that, claiming employees told Hussain about potential brake issues.
In addition to the two failed roadside inspections, the documents say State Police stopped the limo on August 25, 2018, near Saratoga Race Course, and cited driver Scott Lisinicchia for not having the correct commercial driver’s license to operate the limousine. Lisinicchia was the limo driver killed in the Schoharie crash.
In the month leading up to the Schoharie crash, the documents also claim the DOT inspector contacted Nauman Hussain four more times, informing him that the DOT had still not received the required documents for the limo's operation or drug and alcohol documents for the drivers.
In addition to the criminal case developments, another civil suit was filed Tuesday in relation to the crash. The family of Amanda Halse joined several other families of victims to file lawsuits against Prestige Limousine, the Hussain family, and Mavis Discount Tire, accusing them of playing a role in causing the deadly crash.
