ROCHESTER, N.Y. — Information obtained from a Monroe County District Attorney’s Office report is shedding more light on the alleged activities of Monroe County Legislator Ernest Flagler-Mitchell.

The report states "that based on the information obtained from our investigation - it is apparent that Ernest Flagler-Mitchell used his standing as a pastor, firefighter or as a county legislator to continually seek out women on social media platforms."

Investigators with the DA's office also note that a few women they spoke with said they had consensual and sexual relationships with the married legislator, with one saying their relationship eventually evolved into money for sex. The report alleges while some women ignored him, others began to have consensual texting and sexual relationships with Flagler-Mitchell because he "gave them money or paid their bills."

Spectrum News 1 obtained more information from documents through a Freedom of Information Act (FOIL) request.

The 55-page report includes interviews with women and screen shots of text conversations. The report claims multiple women allege he sent unsolicited pictures and videos of his penis to them.

The women include LaKaya Sinclair, who had previously come forward alleging that Flagler-Mitchell sexually harassed her by texting her a photo of his genitals when she was 19 years old. The two had met after last September's mass shooting at her home on Pennsylvania Avenue. Flagler-Mitchell says he sent the picture in error.

The District Attorney's Office determined that Flagler-Mitchell's behavior was not criminal, but the office turned the files over to the county Board of Ethics, which did rule that Flagler-Mitchell's exchanges with Sinclair violated the county's ethics code.

The release of the report has Monore County Executive Adam Bello calling on his fellow Democrat in the county legislature to step down:

"The District Attorney’s report tells the story of women in our community who turned to an elected official for help, but were instead subjected to revolting and terrorizing behavior.  I’m disgusted.

Ernest Flagler-Mitchell violated the public’s trust, and must resign from public office immediately.

The women who came forward have shown incredible courage in the face of public scrutiny – scrutiny that far too many women in their position face.  When public officials dismiss their truth, run for cover, and refuse to act, their trauma is only deepened.

The County Legislature has a responsibility to act, and they must do so today.  I am calling on Joe Carbone and the Republican Majority to stop covering for Ernest Flagler-Mitchell. It is past time for them to drop their opposition to the ethics reform and censure resolutions, and immediately hold a special meeting of the County Legislature to adopt measures that will hold Flagler-Mitchell accountable for his behavior. Failing to do so only serves to empower Flagler-Mitchell and provide him with a platform to continue to prey upon unwitting constituents."

Also calling for Flagler-Mitchell's resignation is Congressman Joe Morelle:

“The results of the District Attorney’s investigation into County Legislator Ernest Flagler-Mitchell show a clear, repeated pattern of alarming and indefensible behavior that has no place in public service. There can be no tolerance for abusing a position of power and betraying the public’s trust. In order to preserve the integrity of public office, he must resign immediately.

“I commend Lakaya Sinclair and the many women who have bravely come forward to share their stories. We stand with you.”

Calls to Ernest Flagler-Mitchell for comment have not yet been returned.
