ROCHESTER, N.Y. — The Monroe County District Attorney's Office says Ernest Flagler-Mitchell, a county legislator, did not commit a crime when he sent a lewd photo to a woman.
Spectrum News is told the DA's office wrapped up its investigation after Flagler-Mitchell admitted sending the photo to 19-year-old LaKaya Sinclair.
He claims the photo was intended for his wife and was sent in error. Sinclair though said it was part of a pattern.
"After that, I thought it was inappropriate. I just didn't respond to it and then he double texted me, 'what you doing.' So to say it was a mistake and you're initiating this even more," said Sinclair.
The DA is sending the findings to the county's Board of Ethics for its own investigation into the allegations of harassment.
Flagler-Mitchell has alleged that politically connected individuals were using Sinclair's complaint as blackmail.
Another person has come forward saying they also received an inappropriate message from Flagler-Mitchell. Rochester City School Board Commissioner Beatriz Lebron says she received an uncomfortable message from Flagler-Mitchell before she was in politics or working in the public eye.
