The Monroe County Board of Ethics is adopting the recommendation from an independent law firm that says county legislator Ernest Flagler-Mitchell violated its code of ethics.

This comes as the legislator faces sexual harassment claims from 19-year-old LaKaya Sinclair.

Flagler-Mitchell says he accidentally sent a lewd picture to the teen.

Sinclair says it was part of a pattern, and the released report says there were dozens of messages sent, but then were deleted.

The report also revealed that the district attorney's office said about 11 women came forward with reports of receiving alleged inappropriate messages from the legislator.

The DA's office concluded its investigation, and while it says Flagler-Mitchell did not commit a crime, the board says he violated section 4513 of the code, saying no one should use their position to secure unwarranted privileges.

"Our next step is that we'll submit the results of the investigation, the report itself, to the county executive,” said Joanne Giuffrida, Monroe County Board of Ethics chair. “That is the process laid out in the code of ethics."

For his part, Flagler-Mitchell has said that politically connected individuals were using Sinclair's complaint as blackmail.

Flagler-Mitchell did not immediately return a request for comment.

Monroe County Executive Adam Bello said Thursday that he's pushing for the legislature to enact ethics reform to provide more teeth, adding, "That the victim’s credible and corroborated accounts resulted in a violation of an ethics policy with no consequences shows a shameful lack of accountability built into our current system."
