The judge in the case of Nauman Hussain, the Prestige Limousine operator connected to the 2018 Schoharie limo crash that killed 20 people, says he will not abide by the plea agreement made in the case.
Judge Peter Lynch set a Dec. 5 trial date for Hussain after the defense decided to vacate the plea deal following Lynch's decision. If the defense had not done so, Lynch would have put forth sentencing.
Lynch had said his recommendation would be jail time for Hussain, who pleaded guilty last year to 20 counts of negligent homicide in connection with the Oct. 6, 2018, crash at the Apple Barrel restaurant.
Under terms of the original deal, Hussain would have been placed on interim probation for two years and served 1,000 hours of community service, after which time he would have served three more years of probation, but no jail time.
