The man charged in a horrific crash that killed a Greece mother was back in court Wednesday.
Matthew Magar was charged with aggravated vehicular homicide, aggravated DWI, reckless driving, failure to stop at a stop sign and speeding. He appeared in court Wednesday for a scheduling hearing and left in his wheelchair.
Magar broke both of his legs in the crash that happened in Parma in January. Dilek Ogut, 41, died in the crash.
Monroe County Assistant District Attorney Karin Intermill says Magar's blood alcohol level was more than four times the legal limit.
"This is an extremely important case for our office. This is a woman who contributed to her community, she had a job, she had a family she did absolutely nothing wrong on January 7, and yet she was killed by a drunk driver who went through the stop sign and killed her with a very high blood alcohol content," Intermill said.
In court, Ogut's brother yelled out, expressing his discontent Magar is not in custody and instead free on bail, which had been set at $15,000 cash/$45,000 bond.
Ogut was a mother of three young children, a 9-year-old and 7-year-old twins.
