Opening statements are slated to begin Tuesday in Syracuse for the criminal trial of former Rochester City Court Judge Leticia Astacio.

The former judge, who has been in and out of court and local headlines since her initial DWI conviction in 2016, is currently charged with attempted criminal purchase or disposal of a weapon. She's accused of attempting to purchase a shotgun from a Henrietta sporting goods store while on probation.

A jury was seated in Onondaga County Court on Monday. This comes after the Court of Appeals granted a change of venue, ruling a fair and impartial jury couldn't be found in Monroe County. 

In court Monday, Astacio's attorney made a motion to have the charge dropped down to a Class E misdemeanor. However, the prosecutor said it was a "far stretch." Judge Gordon Cuffy also ruled that a recorded interview with Astacio and a Monroe County Sheriff's investigator could be used in the trial. 

In addition to fighting the criminal case, Astacio is also running for the northwest city council position. She could lose her law license if convicted of the felony weapon count.
