The criminal case against former Rochester City Court Judge, Leticia Astacio will go forward, but it won't happen in Monroe County.

In a very rare move, the New York State Court of Appeals granted a change in venue.

The appellate judges ruled Tuesday that a fair and impartial jury couldn't be found in Monroe County. The case is now headed to the Syracuse area in Onondaga County. 

Astacio has been in and out of court and local headlines since her initial DWI conviction in 2016.

She's currently charged with attempted criminal purchase or disposal of a weapon. She's accused of attempting to purchase a shotgun from a Henrietta sporting goods store while on probation.

Her trial was originally set to get underway this month. 

Astacio was removed from the bench in October.
