The man accused of shooting his wife while cleaning his gun in Saratoga County last November has pleaded guilty.

Eric Rosenbrock entered a guilty plea to criminally negligent homicide in the death of his wife, Ashley. Rosenbrock was previously charged with second degree manslaughter after authorities say he recklessly shot and killed his wife while performing maintenance on his 9mm handgun.

Monday in court, Rosenbrock was emotional as he recounted what happened.

He told the judge that he was oiling his gun in preparation for a hunting trip. When he reassembled it and put the magazine into his pistol, Rosenbrock says he did not check to see if there were bullets in the magazine.

“After the magazine was in the pistol, I turned and I racked the slide, and when doing so, the pistol went off and discharged and the bullet struck my wife sitting on the couch, resulting in her death," Rosenbrock said.

Rosenbrock will avoid jail time, and be able to continue to care for his three children. If he had gone to trial and been convicted, he could have faced up to 15 years in prison.
