ROBESON COUNTY, N.C. – The man accused of killing 13-year-old Hania Aguilar last November is expected in court Monday.

Michael McClellan is charged with the kidnapping, rape, and murder of Aguilar.

If convicted, he could face the death penalty.

Hania was kidnapped on November 5, 2018 while sitting in an SUV in her front yard.

The SUV was found abandoned in a wooded area a few days later, but Aguilar's body was not found until November 27.

McLellan was charged with first-degree murder, first-degree forcible rape, and first-degree kidnapping in this case.

Following McClellan's arrest it was uncovered that DNA evidence could have taken him off the street for a 2016 rape.
