AUSTIN, Texas — Austin Independent School District is facing a lawsuit from parents over its handling of sexual assault cases.

  • Lawsuit claims AISD didn't do enough to investigate allegations

  • Claims the district discriminated based on sex, gender

  • District says it doesn't tolerate any form of sexual assault

The lawsuit claims the district didn’t do enough to investigate several cases of alleged sexual assault. The cases involve a high school student allegedly assaulted by a male student in a bathroom, two pre-kindergarten students allegedly assaulted by a teacher, and a student with disabilities allegedly inappropriately touched by a cafeteria worker.

According to the lawsuit, all cases were handled by school officials and the AISD Police Department. Parents in the suit say no arrests or firings were made in response to the investigations and that none of those cases were referred to the district’s title IX coordinator. The lawsuit claims the district also failed to provide counseling and resources to alleged victims.

Parents part of the suit say the lack of action proves the district discriminated against the alleged victims based on sex and gender. The parents of the alleged victims spoke out Thursday, saying the district's response to the allegations caused even more trauma.

“When the case gets reopened cause you didn’t do it right the first time, that child has to go through another forensic interview and get revictimized all over again,” one parent said.

“We still deal with it today,” said another. “We still have problems, even going to the store.”

Austin Independent School District responded to the lawsuit in a statement earlier in the week:

“Austin ISD has not yet been served with the lawsuit but will address the issue at the appropriate time. AISD does not tolerate any form of sexual violence or assault. If a student believes that they have experienced prohibited behavior, they should immediately report the alleged act. All claims are taken seriously and the district will make every reasonable effort to protect our students."
