KYLE, Texas – Kyle police have arrested the parents of a toddler who died on the Fourth of July.
Stevie Dwayne Williams, 24, and Dazrine Ruth Chagoya-Williams, 20, are both arrested capital murder of a person under 10 years old. If convicted, they could face the death penalty.
Authorities found their 20-month-old boy unconscious and not breathing at a home on Marquitos Dr. in Kyle, near Bebee Rd about a mile east of I-35. Rescue crews tried to revive him, but they were unsuccessful and pronounced him dead at the scene.
"Kyle Fire Departments report stated the child was cold and stiff, pulseless and apneic," court records said. "Injuries on Victim's body were visible, to include bruising on his left and right rib area, bruising on his back and bruising on his forehead."
Kyle Police Chief Jeff Barnett confirmed those injuries in a news release Tuesday.
Court records detailed a history of child abuse suffered by the 20-month-old boy, who was not named in the affidavit or criminal complaint. In early 2017, the Texas Department of Family and Protective Services intervened and removed the boy from his parents' custody after discovering signs of abuse.
"The Victim had sustained multiple rib fractures, a wrist/forearm fracture and burns to his foot, leg and genitals from hot water," court records said. "Victim was removed from the care of (Williams) and (Chagoya-Williams) for approximately 11 months. Victimwas placed back in the home...after they completed parenting clases."
Court records said case workers monitored the home for the next three months, but monitoring stopped. The boy died three months later.
"This is a tragic case, and our Office of Child Safety is analyzing prior CPS involvement with this family to determine if previous investigations were handled the way they should have been handled," said Patrick Crimmins, a spokesman for Texas DFPS.
The couple’s infant daughter has also been taken away after she was also found with injuries, including "multiple rib fractures, a skull fracture and a lacerated kidney," court documents said.
The Williams are being held without bond at the Hays County Jail. Relatives declined Spectrum News' requests for comment. Court documents do not list their attorney.
