AUSTIN, Texas — An arrest has been made in connection to the Fourth of July shooting in Austin. 

Jason Roche, 41, was arrested and charged with first-degree murder on July 5.

According to the affidavit, police received a call of a disturbance with a gun between two men. The call was then updated stating one of the men had been shot. When they arrived at the scene, officers found 19-year-old Devonte Ortiz with trauma to his body.

Officers immediately began CPR and continued until Austin-Travis County EMS arrived and transported Ortiz to Dell Seton Medical Center at the University of Texas. However, Ortiz was pronounced deceased at 2:12 a.m.

Police identified Roche as a suspect and took him and other witnesses in for questioning. Roche said he approached Ortiz earlier in the night asking him to stop shooting fireworks. Ortiz continued to do so, and that’s when Roche approached Ortiz again and the shooting ensued.

Roche told police he shot Ortiz in self-defense because Ortiz was reaching for a firearm. He also said Ortiz pulled out a firearm minutes before the shooting but placed it on the ground on the driver side of the vehicle.

Witnesses also recorded cell phone video of the the altercation between the two men showing both Ortiz and Roche in a verbal altercation. Jason Roche’s father, Dennis Roche, tried to intervene during the altercation. Dennis Roche and Ortiz then engaged in a verbal altercation and start shoving each other. At one point, Ortiz pushes Dennis Roche who ends up falling to the ground. At this point in the video, Ortiz was not holding a firearm. After he shoves Dennis Roche, Jason Roche responded by shooting Ortiz.

Jason Roche is booked into the Travis County Jail, and is being held on a $250,000 bond.
