Monroe County's 21st district seat is vacant this morning.

Former Legislator Mark Muoio's resignation took effect at midnight Monday.

This district covers Rochester's east side.

Muoio said he currently has two houses and always intended to resign once his home on Wisconsin Street transferred to a new owner.  He sent in his resignation letter Friday.

Muoio said in a statement he's donating two paychecks he received from the county in August to FoodLink and The House of Mercy.

Republican leaders Friday had called for his replacement immediately.

Muoio said at the time that "As public officials our actions, both official and personal, should be above reproach... I understand the objections that people in the community have and I believe the 21st District should have a new legislator seated as soon as possible."
