Prosecutors are releasing new information about the underage suspect charged in connection with an alleged bomb plot against an Islamic community southeast of Binghamton.
Spectrum News obtained a criminal complaint filed against the 16-year-old Greece Odyssey student. Spectrum News knows his name, but is not reporting it because the minor is currently being charged as an adolescent offender.
While the student is a minor, the Monroe County District Attorney's Office will be going after him in adult court.
"Our position in that case will be that it is an exceptional circumstance that merits ordinary criminal prosecution. That's the stance that we're going to take in court on that case," said Daniel Strollo, Monroe County senior assistant district attorney.
Strollo says the teen being charged as an adolescent offender is suitable for a minor who allegedly commits an adult felony.
"We're going to try to retain it in criminal court because that case is exceptional," said Strollo.
He also explains why he believes it will fall into this category, "One of the allegations in that case is that he possessed three bombs and actually made those bombs with the alleged intention to use them. If that case isn't exceptional, then I don't know what is."
The teen and three other young men are each charged with three counts of criminal possession of a weapon and one count of conspiracy. More charges could be added by a grand jury.
The Raise the Age law that took effect on October 1, 2018 allows a minor to be removed from the youthful eligibility if exceptional circumstances are proven.
The young offender is being held on bail of $1 million, much higher than the bail for the others. He's being held in the youth detention facility in Rush.
