The New York attorney general will not file charges against a former Troy police officer who got into a fatal crash while responding to a call in February 2023.

According to a report released by the attorney general's office, officer Justin Byrnes was going 88 miles an hour when he entered an intersection, hitting another car.

The driver, Sabeeh Alalkawi, had the green light.

The attorney general's office says it did not file charges because prosecutors would "not be able to prove beyond a reasonable doubt at trial that the involved officer committed a crime."

Troy Mayor Carmella Mantello and police chief Daniel DeWolf issued a joint statement Tuesday morning, saying in part, "The release of this report is an important step in that process. We are committed to moving forward in a manner that prioritizes accountability, public safety and community trust. We continue to mourn the loss of Mr. Alalkawi."
