It's been just more than a week since Noelvin, a 3-year-old from Orlando, was discovered on a porch in Buffalo.

"He was just saying that the car was on fire, the car was on fire,” said Lois Augsburger, who found Noelvin on her porch.

Days later, Spectrum News learned exactly what the toddler meant when he spoke those words to the homeowner who found him.

Just a mile away, the vehicle that carried Noelvin, his parents Nicole Plaud, Miguel Valentin Colon and friend Dhamyl Roman-Audiffred, was found burned behind a warehouse on Tonawanda Street.

"He was a potential witness to the crime involving his parents so they needed him here for the police to do whatever investigating they wanted to do,” said Robert Vario, family law attorney.

Two sets of human remains were found inside that vehicle.

Police released surveillance footage where the toddler can been seen running away from the burning vehicle alongside two persons of interest.

"We just want my grandson to go back to his routine," said Noelvin’s paternal grandma, Zenaida Colon.

Since the ordeal, Noelvin has been in the care of Child Protective Services.

Zenaida Colon took the first flight out of Orlando to Buffalo to bring him home. Her initial request for custody was denied. Vario says Colon has now met all of the requirements necessary to get custody.

"The department of social services down in Florida, they did a home study down there and found her home to be more than adequate for the child to reside in. They did finger printing to make sure she had no criminal record,” he said.

As investigators work to determine what happened to the three adults, Noelvin's grandparents will be in Family Court in Buffalo to expedite his return to Florida.

"Now he is asking when he can come home that sort of thing. I think it's definitely the best place for him to be,” said Vario.

The final decision on where the toddler ends up is now in the hands an Erie County Family Court judge.
