A Cohoes man who authorities say fled the country after being charged in connection with the 2019 death of his infant child was arrested in Mexico City and faces extradition, the U.S. Marshals Service announced Friday afternoon.
Anthony Ojeda, also known as Erik Jonathan Donas-Ojeda, along with his husband, Neil Garzon, were arrested by Mexico authorities with the support of U.S. Marshals on Wednesday after more than two years on the run together, the Marshal's Service said.
Ojeda, now 42, was charged with manslaughter and assault in the December 2019 death of his 6-week-old son, Eli, in Cohoes. Emergency responders found the infant unresponsive in a Cohoes apartment, and an investigation and autopsy revealed the baby died of acute methamphetamine toxicity and physical trauma, authorities said.
Ojeda and Garzon were determined to have left the area together to avoid prosecution in the summer of 2021, when Ojeda failed to appear for a court appearance, Marshals said.
Ojeda was added to the 15 Most Wanted list in May 2022. He will remain in the custody of Mexico pending extradition proceedings; Garzon was taken to the U.S. to face charges of endangering the welfare of a child and hindering prosecution in Albany County, federal officials said.
“I want to express my gratitude to the women and men of the United States Marshals Services (USMS) Mexico Foreign Field Office and the Interpol-Mexico Office for their tireless effort in apprehending Anthony Ojeda, a dangerous fugitive on the USMS 15 Most Wanted list,” USMS Director Ronald Davis said.
“We are incredibly thankful to members of the community and our partners across law enforcement spanning two countries who assisted us in capturing this dangerous offender wanted for murder,” said David McNulty, U.S. Marshal for the Northern District of New York.
