The New York State Attorney General's Office of Special Investigations determined criminal charges will not be pursued against police officers in the case of a Catskill man who caught fire and died after an officer shot him with a Taser.
Jones, 29, caught fire in the lobby of the Catskill Police Department on the evening of October 29, 2021, after he had doused himself with hand sanitizer. He died 47 days later from injuries related to third-degree burns.
The OSI concluded, based its investigation, criminal charges could not be proved beyond a reasonable doubt.
"In this case, the CPD officers attempted to subdue Mr. Jones with a device that is not usually lethal to take him to a hospital, believing he was a danger to himself or others," the OSI states in a report released Friday. "The video from the stationhouse lobby shows their shock when the hand sanitizer ignited, and the investigation showed that their training did not warn them against using a Taser around hand sanitizer."
Jones' family has filed a civil suit in federal district court in Albany.
"Our civil suit has no relationship to the decision not to criminally prosecute anyone," an attorney for the family of Jason Jones said Friday.
In its report, OSI recommends training for members of law enforcement on the safe use of Tasers and similar weapons.
