Days after he was released from custody because of new criminal justice reforms put in place this year, an Albany man was indicted for murder and will return to court this week.

A grand jury indicted 52-year-old Paul Barbaritano on a second-degree murder charge in connection to the death of Nicole Jennings. He was previously facing manslaughter charges, which allowed him to request to be released under the reforms that went into effect earlier this month.

Jennings was found dead inside an Albany apartment last July, and a grand jury determined that Barbaritano intentionally caused her death, which is why his charges have been upgraded.

Earlier this month, the district attorney's office argued Barbaritano has made admissions that he caused Jennings' death and he shouldn't be released despite second-degree manslaughter — a charge not serious enough for a judge to set bail.

But now that all the evidence has been analyzed, the charges have been upgraded.

Defense attorneys allege Jennings' death was a horrible accident and a "perfect storm of tragic events."

Barbaritano will be arraigned on Wednesday.
