There are new developments in the criminal the case against Schoharie limousine operator Nauman Hussain. The court ruled today that the criminal indictment against him will stand.

It comes after Hussain's defense team moved for the case to be dismissed in part, claiming Mavis Discount Tire was largely to blame for doing shoddy work on the limousine that crashed last October.

The Schoharie District Attorney's office argued that Hussain, the operator of Prestige Limousine, was told by state officials several times that the limo was not in compliance with state law. The court again sustained the 20 counts of manslaughter and 20 counts of criminally negligent homicide against Hussain.

Another point addressed in Tuesday's court documents is the defense has requested a number of statements be suppressed, claiming Hussain did not give them voluntarily.

The court has not ruled on suppression at this time.

There will be a hearing to address the issue on November 4.
