A judge has dismissed part of a lawsuit filed by Edson Thevenin's family after the fatal 2016 police-involved shooting in Troy. The bulk of the claims, including that Thevenin's civil rights were violated, can move forward to trial.
Thevenin was shot and killed in 2016 by Sergeant Randall French. French was cleared shortly after.
But, a report by the Troy Police Department’s Internal Affairs division questioned French’s account of the events and determined his actions, “greatly contributed to the outcome.”
While the judge dismissed Thevenin family's claim saying the city of Troy and the police department did not properly train officers in the proper use of deadly physical force, suits for wrongful death, assault and battery, and violation of Thevenin's fourth and 14th Amendments may proceed.
This comes after a rally was held in support of Edson Thevenin outside the Troy City Council on Thursday and a city council law committee meeting on Wednesday.
