A man who was shot during an incident in the city of Tonawanda on Tuesday has died.
It all started when Matthew Gerwitz, 28, allegedly shot the 32-year-old man on the corner of Morgan Street and Clinton. The victim has been in the ICU at ECMC where he succumbed to his injuries.
Erie County District Attorney John Flynn says Gerwitz also fired shots at police officers with a homemade illegal assault weapon. A city of Tonawanda police detective who was shot multiple times during the incident is out of the hospital and recovering at home.
Gerwitz has already been charged with attempted murder and criminal possession of a weapon, but those charges will likely be updated now that the victim has died.
Authorities say Gerwitz used a homemade 9 millimeter. While officers were investigating they say Gerwitz unexpectedly went back to his apartment a couple of houses away from the scene.
Gerwitz allegedly fired shots from inside the home at officers.
Detective David Ljiljanich, a 19-year veteran of the force, was hit.
Gerwitz allegedly took off in a car after the shooting. A police lieutenant rammed his car. That officer broke his wrist.
"There actions in opinion saved lives, and they might have saved a lot of lives...I couldn't be more proud of their actions and performance,” said Flynn.
"For a small city, a safe city, they have one of the finest police departments in this country and in this state and their actions and words and what they did the other day with preventing the loss of life and preventing further tragedy is to be congratulated and to be called out.”
Flynn says Gerwitz is a gun enthusiast. He's due back in court next month.
