A report released Tuesday is shedding light on the relationship between two men killed in a shooting in a south Raleigh neighborhood on Jan. 21. An officer was also critically injured in the shooting.

According to the Raleigh police report, 70-year-old Antonio Rodrigues broke into his ex-wife's home and fatally shot her boyfriend, 73-year-old John Rowe. Rodrigues was later killed in a shootout with police.

It happened at a home on Democracy Street just before 6 p.m., in a neighborhood south of Raleigh's downtown area.

The timeline

A woman called 911 and said that her ex-husband, later identified as Rodrigues, broke into her home and assaulted her boyfriend, Rowe, with a stungun, according to the report. The woman also said she had a domestic violence protective order against Rodrigues.

Rodrigues left and returned about 15 minutes later, armed with a shotgun, according to the report. He broke in and shot Rowe as police were on their way to the home, according to the report.

"The 911 caller ran outside, informing a responding officer that '[her] boyfriend is dying on the floor' and confirming that the shots heard were coming from the rear of her residence," the report states. 

Officers entered the home. One officer provided aid to Rowe, while the other officers continued through the home, eventually finding Rodrigues inside near the garage.

"Despite repeated commands directing him to show his hands and drop the weapon he was holding, Mr. Rodrigues fired multiple shots at the officers. In response, Officer Henry fired towards Mr. Rodrigues before seeking cover," the report states. 

Other responding officers used an armored vehicle to break through the garage, and Rodrigues went inside and continued firing shots, striking officer Gillick, according to the report. 

"As Mr. Rodrigues fired his weapon, SEU officers deployed flashbangs near the interior garage door as Captain Gartin, Lt. Smithey, and Officers Batts and Webb returned fire, fatally shooting Mr. Rodrigues," the report states. 

That's when Gillick and Rowe were taken to a hospital, where Rowe later died. EMS pronounced Rodrigues dead at the scene. 

Gillick is still hospitialized in critical condition, Raleigh police told Spectrum News 1 on Jan. 28. 

"A Rossi .44 Magnum lever-action rifle was recovered from the ground next to where Mr. Rodrigues was lying," according to the report. "A 9mm ghost gun, 3 along with ammunition, were found in Mr. Rodrigues’ waistband. At the time, he was wearing a bandolier belt across his chest."

Hand explosives were found in Rodrigues' vehicle, according to officials. 

Two homes had ballistic damage, but no other people were hurt, according to officials. Five Raleigh Police Department officers fired a total of 43 rounds during the shooting, according to the report.

"I do want the community to pray for our officer. Our officer suffered a serious gunshot wound in the gunfire exchange with the suspect and he is in the hospital at this time, and we need your prayers," Raleigh Deputy Chief Rico Boyce said just after the shooting. 

The State Bureau of Investigation is also investigating, which is the standard procedure when a police officer is involved in a shooting.
