Highway Patrol released the video of the shooting Tuesday morning

Trooper Rodney Cook pulled over a Ford pickup for a suspected seat belt violation on Harmony Drive in Siler City May 30 around 4:30 p.m., according to the North Carolina Department of Public Safety. Video shows the trooper asking Mark Anthony Diaz, 21, of Staley, to get out of his truck after he fails to give him an ID, authorities said. Cook also suspected drug use, NCDPS said.

Once asked to get out of the driver's seat of the truck, Diaz pulled out a handgun, the video shows. Cook then tried to block the gun and moved back toward his patrol car. The trooper fired a shot at Diaz as he stepped out of the truck with the gun, according to the video.

The dashcam video shows Diaz down on the pavement as Cook called in the incident from his car. He shouted for Diaz to drop the pistol still in his hand. Cook approached Diaz, gun drawn, and knocked the pistol away from Diaz. He then called for EMS and began administering CPR, the video shows.

Shortly after, EMS arrived at the scene, which appears to be a quiet residential street.

“The driver was transported from the scene, but he was pronounced deceased at a later time,” NCDPS Commander Col. Freddy Johnson said is a news release.

Cook, who has been with the Highway Patrol for 16 years, wasn’t hurt in the incident. He will be on administrative duty while an investigation is conducted, which is standard protocol, Johnson said.
