Matthew Hamilton filed a lawsuit earlier this month, saying the Board of Directors fired him illegally. 

On Tuesday morning, a Union County Superior Court judge denied a preliminary injunction requested by his legal team.

The lawsuit alleges the board violated North Carolina Open Meetings Law, which would require an open process when making decisions. 

His lawyers say they wanted the court to find that the board violated the Open Meetings Law, and therefore their decision to fire Hamilton was void. 

They argued if found void, Hamilton should be reinstated.

However, the judge did not grant the injunction, and Hamilton remains terminated.

"We respectfully disagree with the judge’s ruling,” said Bo Caudill, one of Hamilton’s lawyers. "We don’t think that ruling addresses the real issues in this case, which we look forward to addressing at a trial.”

The Union Day School legal counsel said it had no comment when asked after Tuesday’s hearing.
