STATESVILLE, N.C. -- The man convicted for the 2008 murder of 20-year-old Ira Yarmalenko has been released.
- 51-year-old Mark Carver was released from Gaston County Jail Tuesday.
- Carver was found guilty in 2011 and sentenced to life in prison.
- A Superior Court judge overturned Carver's conviction, citing ineffective assistance by Carver's trial attorneys and questions about DNA evidence.

Yarmalenko's body was found strangled by her car near the Catawba River in 2008. Carver and his cousin were fishing nearby. They were both charged with murder.
Carver's cousin died before the trial, but Carver was found guilty and sentenced to life in prison.

Last week, a Superior Court judge overturned Carver's conviction, citing ineffective assistance by Carver's trial attorneys and questions about DNA evidence. Carver has been granted a new trial.
Carver must wear an ankle monitor while he's out of jail and awaits a new trial.
