It seems Gary Thibodeau will be back in a courtroom again soon. His defense attorney says the New York Court of Appeals will hear his case.
Thibodeau was the only man convicted in connection with the disappearance of Heidi Allen. Allen was kidnapped from a New Haven convenience store in 1994, and her body was never found.
Thibodeau was convicted and sentenced to 25 years in prison for kidnapping. Defense attorneys say that conviction should be thrown out due to new witnesses that have come forward in the case. Lawyers believe it points to new suspects that committed the crime.
Oswego County prosecutors say Thibodeau's conviction was justice.
The appellate division of the State Supreme Court denied Thibodeau's motion earlier this year. No date for a hearing in the Court of Appeals has been announced yet.
