TEXAS — On Friday, Texas’ Request to Examine statute, which grants Attorney General Ken Paxton the ability to probe businesses and organizations for state law infractions, was invalidated by Judge Mark Lane of the Western District of Texas.

According to Bloomberg Law, Spirit AeroSystems, a Kansas-based manufacturer of Boeing 737 jets, is the company who brought the lawsuit to court. The company is under investigation from Texas for allegedly providing misleading information about its parts.

Back in March, Texas Attorney General Ken Paxton sent a “request to examine” letter to Spirit AeroSystems. Paxton was investigating the airplane parts as well as diversity, equity and inclusion commitments.

Texas Attorney General Ken Paxton has filed many lawsuits investigating businesses and organizations for allegedly violating state laws. One of these lawsuits targets Annunciation House, a nonprofit in El Paso that provides hospitality to migrants, immigrants and refugees. In this case, the Request to Examine statute is no longer considered constitutional.
