TEXAS — The American Civil Liberties Union, along with various migrant rights organizations, filed a lawsuit on Wednesday, challenging President Biden’s crackdown on asylum at the U.S.-Mexico border.

President Biden issued the temporary restriction on asylum claims last week, which shuts off access to asylum protections for some migrants arriving at the U.S.-Mexico border.

Asylum seekers who obtain one of the 1,450 daily appointments at U.S. ports of entry remain eligible to apply for asylum.

The lawsuit claims that the restrictions on asylum implements a screening policy that will result in the systematic rejection of individuals seeking refuge from persecution, torture and death.

The lawsuit also argues that the ban contradicts the asylum statute, which grants migrants the right to apply for asylum regardless of their entry point.

“These policies are a direct violation of the laws of our country and do nothing to address the root causes of migration. By limiting the number of people who can claim asylum, people are forced to compete for the few appointments available each day in the CBP One App, which is riddled with glitches and is itself a barrier to seeking asylum. This executive order not only violates asylum law, but our values as a country,” said Tami Goodlette, director of the Beyond Borders Program at the Texas Civil Rights Project.

The lawsuit represents the initial examination of the legality of Biden’s border crackdown.
