KEENE, Texas — A Texas 12-year-old and 20-year-old have been arrested and charged with the murder of a Sonic restaurant employee.

According to Keene Police Department, officers received a call around 9:30 p.m. on May 13 that there was a shooting at the Sonic Drive-In located on the 300 block of South Old Betsy. Upon arrival, officers were directed to Sonic employee Matthew Davis, 32, who was lying on the ground after being shot several times. Davis was flown to Harris Methodist Hospital and rushed into surgery, but he died.

Keene police believe the suspect, 20-year-old Angel Gomez of Fort Worth, arrived at Sonic in his vehicle with other passengers in the car. Gomez then began acting disorderly in the parking lot and was confronted by Davis. As the altercation turned physical, a juvenile in the car’s passenger seat grabbed a firearm and fired multiple shots, hitting the victim. According to CBS News, the 12-year-old used an AR-style weapon and fired at least six rounds at Davis.

Gomez and the juvenile fled the scene. However, Gomez was taken into custody when he returned to the scene during the investigation. Further investigation led officers to a location in Rio Vista, about 15 miles from the scene, where they located the juvenile and multiple firearms. The juvenile was taken into custody alongside Gomez.

The Sonic was closed on Monday.
