BOERNE, Texas – A Kendall County grand jury indicted three people on Monday, having found probable cause against each for the offenses of misapplication of fiduciary property.

  • Allegedly misapplyed over $177,000 from Boerne High School
  • Woman allegedly diverted money to her husband and friend
  • Allegedly used her treasurer position to misapply funds

The misapplication charges range between $150,000-$300,00 plus theft charges between the same range. Both offenses are second-agree felonies.

Nicole L. Allwein-Villanueva, Joel M. Villanueva, and Laura A. Lancaster are believed to have participated in misapplying and appropriating over $177,000 from the Boerne High School Band Boosters and Chaparral Cabinetry between January 2016 and December 2018.

According to Boerne police, Nicole Villanueva used her position as treasurer with the Boerne High School Band Boosters to divert $87,500 to Chaparral Cabinetry, where she was employed and managed the business. In the course of her employment, Nicole Villanueva gave herself, her husband, Joel Villanueva and her friend, Laura Lancaster money from Chaparral Cabinetry totaling over $90,000.

Additionally, Lancaster went to the City of Boerne and signed a new Utilities Commercial/General Services Contract for Chaparral Cabinetry using the real Chaparral’s account and information listing herself as the contact and authorized agent. The business owner’s name was forged, investigators said. 

Each co-defendant has been indicted for one count of misapplication of fiduciary property one count of theft. Lancaster’s bond is $50,000 for each offense, Nicole Villanueva’s bond is $100,000 for each offense and Joel Villanueva’s bond is $50,000 for each offense.

Nicole Villanueva and Joel Villanueva were arrested Thursday evening and transported to Kendall County Jail while Lancaster was arrested in Bexar County and transported to Bexar County Jail.

The case was investigated by the Boerne Police Department with assistance from the Department of Public Safety, and the Kendall County District Attorney’s Office.
