AUSTIN, Texas — Austin police are seeking the public’s assistance in a November 2017 murder.

Charges against the original suspect, Mario Guajardo-Garcia, were dropped on Jan. 23, 2018.

Samuel Charlez was shot Nov. 23 near the 9700 block of North Lamar. Charlez was taken to North Austin Medical Center and later transported to Round Rock Hospital for surgery but died Dec. 6.

The second living victim has decided not to cooperate with this continuing investigation and has recanted on his statement identifying Guajardo-Garcia as the shooter, to include saying he picked the wrong person out of the photo lineup he was given.

Furthermore, several other witnesses on scene have come forward and stated that Guajardo-Garcia was not the shooter and have described the suspect as a younger Hispanic male.

APD says its currently investigating different leads at this time and that Guajardo-Garcia is still a person of interest in this case, however, based on the information provided, can’t justify keeping him in jail under the two charges of aggravated assault with a deadly weapon.

At this time, there are no suspects identified.

Video of the suspected SUV entering and leaving the parking lot at 9616 N. Lamar Blvd is below. It has been described as a blue Chevrolet Suburban or Tahoe.
