GEORGETOWN, Texas — In court Friday morning, the judge presiding over the Greg Kelley hearing ruled that there will be no bond set for him yet.

She said must first go over all evidence and make her findings in this case before she is able to.

Greg Kelley is currently serving a 25-year sentence, but his lawyers say he's innocent.

Throughout the first 2 days of this hearing we've been talking about the new suspect in this case — 20-year Johnathan McCarty.

On Thursday, for first time we learned there's now a third suspect in this case — that person has not been identified

Kelley was living at McCarty's house in 2013 at time of accusations where McCarty's mom ran a daycare.

Two kids from daycare made these sexual assault accusations and Kelley's lawyers say the children got the two teenagers mixed up.

Going back to day 1, the Cedar Park detective who led the 2013 investigation admitted on the stand that he never followed up on McCarty despite the fact that he was also named by the victim during a forensic interview.

He added he never visited the site where the abuse happened.

On day 2, we heard from seven witnesses including Cody Mitchell, a Texas Ranger who was brought on by the District Attorney's office. He told the court he believed there was witness tampering by the Cedar Park police officers during that forensic interview.

"Two officers went into the room and approached the situation more like they were talking to a suspect instead of a victim, especially a 4-year-old victim, and did it in such a way that it was leading. It was suggestive, pretty much telling them that 'you said such and such, right?’,” Mitchell said.  

He also testified that Kelley is still a suspect, cannot be ruled out, but added that so is McCarty, as well as this new, third suspect we just learned about.
