CHARLOTTE -- More than three weeks ago, on Sept. 20, Rakeyia Scott watched her husband die, and for the first time since then, she's talking about that day and remembering the moments that led up to his death.
"I was there. I saw this incident unfold in front of my face," Scott said.
The Charlotte-Mecklenburg Police Department says 43-year-old Keith Scott, a father of seven, married to Rakeyia for 20 years, was shot and killed by CMPD Officer Brently Vinson.
They say Scott had a gun, which they recovered at that scene. They also said he posed an imminent deadly threat.
During a nearly five-minute interview with CBS News This Morning, Rakeyia says she still doesn't believe that's true.
"He had no gun. He was not a threat, and he was just not a threat period. He didn't have a gun, he was just not a threat, what is your purpose? What was your reasoning? You saw him backing up...why didn't you just give him a command then?" she said.
Family members and their attorneys also say they don't believe Scott was a threat, and they say their independent autopsy backs up their theory.
"We've seen video, the dash cam, we've seen the body cam, and there's no definitive evidence to show that he had a weapon in his hand. In fact, we seem to see from the camera he's backing away from the police. So, whoever shot him over the left shoulder with the other police in sight," said Eduardo Curry, an attorney for the Scott family.
The independent autopsy shows Scott was shot at least four times; in the upper back, the stomach and twice in his left hand.
Kim Collins, the forensic pathologist who conducted the autopsy said, "the manner of death is homicide."
"It troubles us, once again, because in an effort to be transparent, we're trying to learn...well, what was happening? Who would be in imminent fear enough to shoot Mr. Scott in the back," said Curry.
The Scott family is still looking for answers and says they will continue to see justice for their loved one.
"Give us your reason, the real valid reason, as to why my husband's life was taken, that day, before me," said Rakeyia Scott.
The funeral for Keith Scott is Friday, Oct. 14 at 11 a.m.
It will be held at First Baptist of James Island in Charleston, South Carolina.
