ROCHESTER, N.Y. — A Rochester Police Department investigator has been placed on administrative duty as part of an internal review in connection with an arrest over the weekend, Interim Chief Cynthia Herriott-Sullivan’s office said in a statement Monday.

The move comes after a video posted to social media showed a man allegedly being kicked and punched by officers during a confrontation with police. 

In a news release, RPD gave their account of how events unfolded. They say a man wanted for multiple felony charges was spotted on Remington Street in the city of Rochester around 7:30 p.m. Saturday. After officers made contact with him, police say a struggle ensued and he was taken into custody. Authorities later identified the man as Jarvis Lewis, 31. Police said that Lewis was in possession of a handgun as he was actively fighting with officers. According to court paperwork, an illegal, loaded 9 millimeter handgun was recovered during the arrest.

Lewis was charged with second-degree assault, criminal possession of a weapon in the second and third degree, criminal possession of a controlled substance in the third degree and resisting arrest.

Another man, Travis Lewis, 32, arrived on the scene during the arrest. A confrontion with officers reportedly developed. He was charged with resisting arrest and obstructing government administration in the second degree.

During the initial arrest of Jarvis Lewis, according to police, one of the officers was injured and taken to a hospital, where he was treated and released. Additionally, two other officers were treated for exposure. Both arrestees are currently in the Monroe County Jail. 

On Monday, Jarvis Lewis was arraigned and charged with assault for an alleged shooting that took place on May 22. He is accused of getting into an argument with a 22-year-old woman on Kohlman Street and firing a handgun into a vehicle multiple times, hitting the woman in the chest. Court paperwork says she was taken by private vehicle to Strong Memorial Hospital, and survived.

Rochester Mayor Lovely Warren made a statement on Saturday night's incident. “I am deeply disturbed seeing a resident kicked while he was held to the ground," she said. "We must ensure that our police department always acts to protect and serve no matter how difficult the situation or arrest. I appreciate Chief Herriott-Sullivan taking quick action to suspend the officer involved and further investigate what occurred.”

Police say body camera footage will be released within 72 hours. Some of the footage remains outstanding, police said, as some body camera "were lost during the incident." The department said an internal review can be based on, but not limited to, the amount of force used or injuries sustained.
