Assemblyman Brian Kolb made a brief court appearance Thursday afternoon, as part of the former assembly minority leader's drunk driving case.
Kolb appeared with his attorney who received evidence in the case from the prosecution. Kolb was ticketed for DWI after police say he after drove his state-owned SUV into a ditch in Victor on New Year’s Eve. They say his blood alcohol level was twice the legal limit.
Regarding evidence, new state criminal justice reform laws require prosecutors to turn all of it over to the defense within 15 days of a defendant's arraignment.
"As soon as I get things I turn them over to the attorney. The new law requires more things to be turned over than previously required, and puts the initial obligation on me to provide it before it's even asked for,” said Todd Casella, prosecutor.
"How would you be doing? It's a tough situation. He's dealing with it best he can. And he's moving along. It's a situation in life and he's dealing with it one day at a time,” said Chris Schiano, Kolb's attorney.
Assemblyman Kolb's next court appearance is scheduled for March.
