The man who served time for shooting Rochester Police Department Officer Anthony Diponzio in the head has been arrested again.
Tyquan Rivera, 25, of Rochester is charged with third-degree criminal sale of a controlled substance, a felony. He's accused of selling fentanyl to undercover police officers. Rivera was one of five men arrested as the result of an investigation which began in August.
"There's obviously an opioid epidemic this community is facing," said prosecutor Matthew Schwartz. "And so even if it's one at a time, when we take someone off the street who's providing these dangerous narcotics it's a good thing."
Rivera was arraigned Friday morning in Rochester City Court. He pleaded not guilty. Bail was set at $25,000 cash/$100,000 bond.
Rivera was just 14 when he shot Officer Diponzio in 2009. He served seven years in prison.
Officer Diponzio was left with permanent injuries and underwent extensive rehabilitation before returning to the department.
