BATAVIA, N.Y. — Two people facing charges in connection with an incident involving a Genesee County sheriff's sergeant appeared in Batavia Town Court Tuesday.

What You Need To Know

  • Suspects connected to incident appear in court
  • Michael Elmore and Lyndsey Wilcox remain in custody
  • Genesee County Sheriff's Sgt Thomas Sanfratello died following an incident with the defendants, police say

Michael Elmore, 33, was formally arraigned on charges of aggravated assault of a police officer with a deadly weapon, aggravated manslaughter in the first degree with intent to cause serious physical injury and burglary with the use of a dangerous instrument — which police say was a thick chain necklace.

Elmore uttered a few words after court, saying, "My life is over," then began sobbing in the back of the sheriff’s transfer vehicle that would take him back to jail.

“Obviously, he’s very upset,” said Elmore's assigned counsel Joseph Lobosco. “I think that’s the best way to describe it right now until I get to know him a little bit better. I can’t characterize it beyond that, but he is very upset about all this, as you would expect.”

The other defendant, Lyndsey Wilcox, 39, also appeared in court, and is charged with attempted assault and burglary.

Both defendants remain in custody.

“Right now, we’re in the early stages. The case was transferred over to the Batavia Police Department, who is handling the investigation. The investigation is still currently ongoing,” said Genesee County First Assistant District Attorney Joseph Robinson. “We’ve still got to look at all the discovery, comply with our discovery obligations [and] send that over to defense counsel. While a case like this may be likely to go to grand jury, it’s at least not scheduled at this point.”

Sanfratello was a 32-year law enforcement veteran. He was 54 years old.

The flag at the Genesee County Sheriff’s Office is flying at half-staff, and there are flowers and a patrol car out front displaying his badge number — 9 — in his honor and memory.

Calling hours will be held on Friday, 2-8 p.m. at the Call Arena at Genesee Community College in Batavia. The funeral will be at the same location on Saturday at 11 a.m.

The defendants are set to be back in Batavia Town Court on April 9.
