Inside the jail house in Wayne County, New York is a wanted fugitive from the state of Texas.

Charlene Childers is being held without bail.

According to a criminal complaint filed in Lyons town court, Charlene Childers is a fugitive from justice in the eyes of the state of Texas.

She reportedly left Texas “to avoid prosecution for the charges of third degree felony injury to a child,” according to court papers.

A spokesperson with the Texas Rangers said Childers is the ex-girlfriend of Joshua Niles.  Niles and his fiancé, Amber Washburn, were both killed last week in Sodus.  They were shot while sitting in their car in the driveway of their home, with their young child in the vehicle.

Childers lives in Sunray, Texas, with her husband, Tim Dean, who is also in custody.

The Moore County, Texas, Sheriff’s office confirms that Dean is in jail there and faces the same charge as his wife.

Dean is the former police chief in Sunray and resigned after he was arrested for the same charge – injury to a child — in May.

At that time, Childers posted a fundraising page trying to raise money for both her custody battle and Dean’s criminal case.

Most recently, Childers attended a vigil held after the deaths of her ex and Washburn.

Childers and Niles share two children together and, according to neighbors, the two were in a lengthy custody battle.

Members of the victims’ families have requested privacy, saying only that they are “hopeful they will catch whoever is involved, regardless of who that may be.”

The Wayne County Sheriff said no one has been charged in connection to the double homicide and Sheriff Barry Virts is only saying that the investigation continues.

Childress will remain behind bars here in Wayne County until her court date on November 27, unless she is extradited to Texas.  Dean is being held on $1 million bond.
