BRIGHTON, N.Y. — A court appearance is scheduled on Tuesday for the former Brighton man accused of using an ax to kill his wife in their home nearly 40 years ago.

The murder of Cathy Krauseneck went unsolved until last year when police charged her husband James with the killing. 

Police say he told investigators he returned from work in 1982 and found Cathy with an ax lodged in her head. The couple's 3-year-old daughter was found unharmed in her bed, according to authorities.

A virtual hearing in the case is set for Tuesday morning.
