Criminal charges will not be filed in the separation agreement and payout between the Newburgh Enlarged City School District and former Superintendent Roberto Padilla, according to a statement released Friday afternoon by Orange County District Attorney David Hoovler.

Hoovler said an investigation found insufficient evidence to file criminal charges.

At the end of last year, Padilla resigned as superintendent following allegations of sexual harassment.

An agreement between the school and Padilla allows him to continue receiving his full salary until November 2023, unless he secures a job elsewhere.

Earlier this month, two teachers accusing Padilla of sexually harassing them officially filed a lawsuit against him, the school district and board of education.

They said the alleged harassment happened at a conference in San Diego last August.

After his resignation, Padilla pointed to an unsigned statement attached to his separation agreement which stated there was no misconduct.

The announcement came less than 24 hours after the school district named Jackielyn Manning Campbell as its new superintendent.

She has worked as an educator for 24 years, serving as teacher, assistant principal and principal.

Most recently, she was acting superintendent of the New Rochelle City School District.
