A viral video from Rome of a manager threatening an employee got thousands of views online earlier this month. In it, you can hear Jason DeShane of the Liquor Warehouse screaming and cursing at an employee. 

Some of the threats got the attention of Rome Police.  

They responded by removing 80 guns from a home under the Red Flag Law, including those belonging to Michael DeShane, who is Jason's father and the business owner.

Michael DeShane appeared in court today to make his case to get his guns back. However, it looks like Michael won’t be getting his guns back from law enforcement anytime soon.

The hearing didn’t address the video. Instead, references were made to an incident at the end of November.

DeShane’s son Jason took the stand. He had allegedly called police on his father to report a domestic incident. The police statement said Jason said his father swore at him, and drew a gun on him. At the time, Jason signed that report as accurate.

Wednesday, Jason said there were inconsistencies in the police report. He said that his father did not draw a gun on him, but that Jason later learned his father was moving the firearm to set it somewhere else.

The police officer who prepared the report took the stand.

She told the court she did not arrest Michael DeShane because there wasn't reasonable cause to believe the incident happened.

The judge ended up ruling in favor of the police department. He pointed out that Jason didn’t object to previously saying he had been afraid for his life in that incident.

Michael's attorney believes this all stems from the viral video.

"It's not coincidental that Michael's temporary extreme risk protection order was filed in conjunction with that of his son only days after this video was shared, which shows my client being completely composed," Michael DeShane's attorney Nicholas Passalacqua.

Michael DeShane’s attorney plans to appeal the court's decision. As it stands, DeShane will not be able to get his firearms until next February.
