One man is in custody after a deadly New Year's Eve fight in Canajoharie.
Canajoharie PD say they were called to a residence at 71 Walnut Street around 11:20 p.m. on December 31. Officers saw two men at the front entrance who were later identified as Joseph T. Herting, 63, and Stanley Hall, 55.
Herting was critically injured while Hall was found lying on the sidewalk, according to Canajoharie PD.
Both men reportedly lived in the 14-room boarding house in separate apartments, and were intoxicated during the brawl. Officers say they gave Herting first aid while waiting on the Canajoharie Fire Department and the Greater Amsterdam Volunteer Ambulance Corps.
Canajoharie PD says officers canvased the area and were able to locate witnesses. They also confirmed video surveillance was secured.
The department says they spoke with District Attorney Kelli McCoski and decided Hall would be charged with assault in the second degree, and placed in the Montgomery County Correctional Facility in lieu of $30,000 cash bail or $60,000 property bond.
An autopsy was conducted and has found Herting died from critical injuries consistent with the altercation.
A neighbor Spectrum News spoke with previously worked with Herting. He says he did not see any problems between the two men when he was with them earlier in the day.
"New Year’s Eve, both of them were at the same place. They didn’t talk, argue, fight, nothing. Joe left, then 45 minutes to an hour later, Stanley left. Then we found [out] what had happened," said neighbor Shawn Chiuminato.
Herting was a member of The Fraternal Order of Eagles in Canajoharie. The organization put together a small makeshift memorial to honor him. They say he was a very active member with a good heart.
They will also remember Herting Wednesday night by leaving his seat, where he watched the Buffalo Bills every Sunday, open.
The Eagles say they will be planning a fundraiser or memorial on behalf of Herting, once they speak with his family about funeral arrangements.
Police say charges against Hall could be upgraded in the future, pending a discussion with the district attorney. Until then, the investigation remains ongoing.
