The attorney for three police officers involved in the April death of an Albany man confirmed the coroner has ruled the death of Donald "Dontay" Ivy as a homicide.

Attorney Michael McDermott told Time Warner Cable News, an autopsy on the 39-year-old Ivy revealed his death was caused by an encounter with three Albany police officers.

Ivy was electrically stunned multiple times during a scuffle with police on Lark Street on April 2, and later died.

Ivy's family says he suffered from mental illness and a heart condition.

The three officers involved have not been charged.

The Albany Police Department placed all three on paid leave during an internal investigation. The case will also likely be presented to a grand jury.

The police department has since changed its policy on stun guns — a change police said was in the works before Ivy's death.
