Prosecutors say grand jury action Tiffany VanAlstyne's case could come as early as this week. She's the 19-year-old accused of beating and choking her cousin, 5-year-old Kenneth White, in their Berne home in December. Katie Eastman has more on how White's death is still fresh in the minds of people in that community.

BERNE, N.Y. -- A memorial for Kenneth White outside his home is now gone for the winter with fears that a snow plow could destroy it all.

But the feelings that came with the hand made cross and flowers are still evident.

"That boy, the sadness I his face, it touched me and it tears me up," said Kenneth's Army organizer Michelle Fusco.

Michelle Fusco started a Facebook page to bring people feeling like her together. That page turned into Kenneth's Army- a group fighting for Kenneth's two sisters and trying to change laws around New York's child protective services.


"We're gonna help other children, we're going to hug other children. It's too late for Kenneth but maybe we can save another child," said Fusco.


Michelle's group partnered with the New York State Children's Foundation, a group that helps children in foster care. Eventually Sheriff Craig Apple would like to turn over the memorial fund to either Kenneth's Army or NYSCF.


"We really didn't want to get into managing a fund but we received so many requests of please do this because people wanted to give and they wanted to make sure it was in a safe place," said Albany County Sheriff Craig Apple.

Already a memorial fund for Kenneth's sisters has more than $4,000 with money coming in every day.


An event is being held Saturday, January 17 at Maggie's Sports Pub in Albany.
