No charges will be filed against Republican State Senator and Congressional candidate Chris Jacobs after the Erie County district attorney reviewed claims of voter fraud that surfaced just days before the special election in New York's 27th Congressional District.

After a thorough investigation, DA John Flynn says there simply isn't enough evidence to charge Jacobs with a crime.

Recently, three separate allegations surfaced of Jacobs committing voter fraud relating to a change of address in 2019.

This included designated petitions including Jacobs’ new Orchard Park address while still living in Buffalo.

Flynn says Jacobs purchased a home in Orchard Park with the intent of making it his primary residence, and registered to vote there before he closed on the home.

Flynn says he did complete the purchase and the intent was not criminal. And while he maintained a home in Buffalo to be close to his mother during the COVID-19 pandemic, that is not illegal.

Flynn says timing and intent is key. Flynn declined to name the person who filed the complaint but suggested that person should come forward.

“In my opinion, if you put your name on something, you come out and say who you are but I understand people don't want to come forward for whatever reason, so I will not identify who the complainant is. I would like to, quite frankly but I'm not going to,” said Flynn.

Though the DA did not name who the allegations came from, Jacobs said it came from one of his opponents in the Republican primary, which will be held on the same day as the election to fill the congressional seat until the November election.

Jacobs released a statement Friday evening, saying:

“I want to thank D.A. Flynn for his swift dismissal of Beth Parlato’s phony complaint. And I further want to thank D.A. Flynn for allowing me to come in of my own volition and present him with complete documentation that completely disproves these attacks from Beth Parlato.”

Jacobs is also calling on Parlato to take down her campaign ads using this investigation to attack Jacobs.

Parlato responded in a statement, saying in part:

“The district attorney admitted Chris Jacobs does not live in our district. Another career politician devoicing voters.”
