ROCHESTER, N.Y. — A federal judge has dismissed an indictment against a well-known Rochester real estate developer.
According to court documents, developer Robert Morgan and his co-conspirators were not given a speedy trial, a constitutional right, due to difficulties by the prosecution to turn over evidence.
Despite the judge's decision, prosecutors could still seek a new indictment.
“As the dismissal was without prejudice, charges may be re-filed. We are currently reviewing the decision and considering our options," said U.S. Attorney James P. Kennedy, Jr. in a statement.
In May 2018, four people, including Morgan's nephew, Kevin Morgan were charged, accused of a massive mortgage fraud conspiracy.
Morgan Communities and Morgan Management, both led by Robert Morgan, own 140 properties across 14 states.
