The Jamestown man charged with hanging a dog from a tree last week was in city court Wednesday.

Robert Overton, 47, waived his right to a preliminary hearing before Judge John LaMancuso.

Overton is charged with aggravated cruelty to animals after he allegedly hanged a pitbull in a wooded area on Hallock Street.

A person recently walking through the area made the discovery.

Overton's wife, Alana, says the dog attacked her husband the night of the alleged incident while he took it out for a walk.

She says Overton is remorseful and being unfairly prosecuted in the court of public opinion.

"My husband is a good man, he's a good father. I just think it's really ignorant all the threats against my family in general. Being very childish and you need to grow up. Just, let the courts handle it,” said Alana Overton.

"I think that when all the facts are known, I think the public opinion will be vastly different than what it is at this juncture. And I can't really discuss the particular factors at this time,” said James Pelletter, Chautauqua County 1st assistant public defender.

Overton was sent back to county jail without bail.

The case now heads to Chautauqua County court, where it’s expected to go before a grand jury.
