One of the two men arrested in a deadly dirt bike crash in Broome County in August has had his charges dismissed.
Eric VanFossen, 50, of Endicott, was originally charged with second-degree manslaughter in connection with the death of 24-year-old Cameron Fortner.
Broome County sheriff's deputies say Fortner was driving a mini dirtbike up Airport Road in the Town of Union on August 18. That's when 48-year-old John Hughes stuck a shovel out in front of him in an attempt to slow Fortner down.
Authorities say Fortner swerved to avoid the shovel, and that's when he hit a parked van. He later died from his injuries.
Deputies charged VanFossen for allegedly participating in activity leading to the collision, but a grand jury ruled there wasn't enough evidence.
Hughes is still facing his manslaughter charge.
